Intellectual property
Certificates of registration of rights to copyright objects for 2012-2026
Intellectual property is the result of intellectual activity and equated means of individualization of legal entities, goods, works, services and enterprises that are granted legal protection. The objects of intellectual property are copyright and industrial property.
The main characteristic of intellectual property is that only the owner of intellectual property, and primarily the author, has exclusive rights to use it, as well as the fact that no other person can use the intellectual property in any way without his permission.
Intellectual property objects are divided into the following types: literary, artistic works and scientific works; performing activities of artists, phonograms and radio broadcasts; inventions in all fields of human activity; scientific discoveries; industrial designs; trademarks, service marks and commercial names and designations; suppression of unfair competition.
Intellectual property includes:
- copyright,
- patent law,
- means of individualization,
- so-called "non-traditional" objects of intellectual property, which include integrated circuit topologies, selection achievements, trade secrets, production secrets (know-how), etc.
Industrial property as an object of intellectual property includes patents for inventions, utility models, industrial designs, trademarks and service marks, trade names and appellations of origin.
Industrial property must be registered with the state patent office in accordance with the established procedure and requires a patent or certificate, only under such conditions does intellectual property acquire the status of industrial property (except for know-how).
RSE on REM "National Institute of Intellectual Property" of the Ministry of justice of the Republic of Kazakhstan (NIIP of MJ RK) is an organization engaged in expert functions of the patent office of the Republic of Kazakhstan.
Copyright as an object of intellectual property includes works of science, literature and art, computer programs, databases, performances, phonograms, broadcast or cable radio or television programs.
Such intellectual property items do not require additional registration. The author has the right to them at the moment of their creation.
An application for the grant of a patent for an invention must contain the following documents:
- application for the grant of a patent indicating the authors of the invention and the persons in whose name the patent is sought for the invention, as well as their place of residence or location;
- description of the invention, revealing it with sufficient completeness for implementation by a specialist in the relevant field of knowledge;
- an invention formula that defines the object of the invention and expresses its essence;
- the formula must be clear, accurate, and based on a description;drawings and other materials, if they are necessary for understanding the essence of the invention;
- report;
- power of attorney, in case of conducting business through a representative.
Documents attached to the application:
- document confirming payment for the application.
Types of patents:
- a patent for an invention is valid for 20 years (with the possibility of extending it for another 5 years).
- a utility model patent is valid for 5 years (with the possibility of extension for another 3 years);
- a patent for an industrial design is valid for 15 years (with the possibility of extension for another 5 years).
